    • “Customer” – a visitor to an Affiliate’s website who clicks on a link and completes a Qualifying Transaction.
    • “Link” – a graphic or textual link located on an Affiliate’s website that, when clicked on by a Customer, directs the Customer to our website.
    • “Qualifying Transaction” – a purchase of a product or service from our website by a Customer who has clicked on a link from the Affiliate’s website.
    • X Company’s Products – the products and services we offer.
    • Qualifying Purchase -purchases of our products and services that generate commissions for Affiliates.
    • “Commission” – the amount of money that an affiliate earns from each sale.

    3. Eligibility/Enrollment Requirements

    In this section, outline the eligibility requirements for participation in your affiliate program. Here’s an example:

    To be eligible to participate in the Affiliate Program, you must:

    • Be at least 18 years old.
    • Have a website.
    • Agree to these Terms and Conditions.

    XYZ Company reserves the right to cancel, modify, or suspend this Trademark Policy at any time and for any reason in our sole discretion.

XYZ Company expressly disclaims any and all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

    Here’s an example:

    This Agreement shall be governed by and construed in accordance with the laws of the State of XYZ, without giving effect to any principles of conflicts of law. Any disputes arising under this Agreement shall be resolved exclusively by the state or federal courts located in the State of XYZ.

    The failure of either party to enforce any right or provision of this Agreement is not deemed a waiver of such right or provision. If any provision of this Agreement is held to be invalid or unenforceable by a court, the remaining provisions of this Agreement will remain in effect. This Agreement constitutes the entire agreement between you and us regarding the subject matter hereof and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and us with respect to the subject matter hereof.
